I think both solutions are effective solutions, however, I think that giving employers the right to fully monitor all employee activities, would be a better solution, different companies have different policies and this way each company could have customized rules about e-mail in the work place; and technically since the employees are on company time, they should only be using e-mail and other forms or electronic communication for work purposes.
